A BMW crashed into a bike on Judges Bungalow Road a decade ago, killing Shivam Dave and Rahul Patel. Vismay Shah, the car’s driver, left the collision scene and was apprehended a few days later.

A sessions court sentenced Shah to five years in prison in 2015 for culpable homicide not amounting to murder.

Shah appealed his conviction to the Gujarat High Court, and before the HC issued its decision, Shah resolved the matter with the relatives of the murdered boys, who did not oppose his appeal.

 The prosecution produced evidence that the BMW was being driven at 120 km/h at the time of the tragic accident, proving reckless driving as the cause of the fatal accident.

Vismay Shah was arrested and charged with culpable homicide but not murder in 2015. 

He challenged his conviction and agreed with the victims’ families, but the Supreme Court affirmed the sentence. Notwithstanding his monetary reparation to the families, the Supreme Court eventually denied his appeal.

A Gujarat court eventually convicted Vismay Shah in the BMW hit-and-run case and sentenced him to five years in jail after over eight years of legal fights and appeals. 

He was also fined Rs 25,000 and ordered to pay Rs 5 lakh to compensate the victims’ relatives

While the decision comforted the bereaved families, they were dissatisfied with the sentence and wanted to appeal to the High Court for a heavier punishment.

Vismay Shah’s BMW hit-and-run case received a worldwide notice and was subjected to protracted court processes. 

Even though critical eyewitnesses became hostile throughout the trial, the court relied on one witness who stood by his statement and took a snapshot of Vismay’s automobile before the collision

Under IPC section 304, part II, the court held him guilty of hasty driving and carelessness, causing a deadly accident.

Vismay was sentenced to five years in jail and forced to pay Rs 5 lakh in compensation to each victim’s family and a Rs 25,000 fine.

The event, caught on Video, killed Shivan Dave and Rahul Patel, two young men hit by Vismay’s speeding BMW. The victims’ relatives praised the court’s decision, expressing happiness that justice had been served.
